Comcare
If you employed by the Federal Government, the ACT Government or a select number of companies (that have applied for licences) then you are covered by the Safety, Rehabilitation and Compensation Act 1988 for injuries sustained in connection with your employment. This national legislation applies instead of the workers compensation legislation in your state.
This national scheme is administered by Comcare. Unlike the ordinary workers compensation scheme which deals with private insurers Comcare is a government entity and its policies and conduct may be influenced by the government of the day.
Disputed claims are managed through a review process starting with an internal review (reconsideration of determination) that can be followed by an application to the Administrative Appeals Tribunal within 60 days. If you remain dissatisfied with the AAT you can appeal to the Federal Court of Australia.
The team at Maxwell & Co can assist you to appeal Comcare decisions.
